About these terms
These Terms of Service ("Terms") are an agreement between you and PedagogyFutures Inc. ("PedagogyFutures", "we", "us"), a 501(c)(3) nonprofit organization. They apply when you use pedagogyfutures.org, the teacher dashboard, our online courses, webinars, forums, groups, prompt library, newsletter, and the sign-in service that other sites use with your PedagogyFutures account (together, the "Services").
By creating an account, buying something, or otherwise using the Services, you agree to these Terms. If you do not agree, please do not use the Services. Our Privacy Policy explains how we handle personal information, and our Cookie Policy explains the cookies we use.
If you use the Services on behalf of a school, district, or other organization, you confirm that you are allowed to accept these Terms for it, and "you" includes that organization. A separate written agreement with your organization, if there is one, takes priority over these Terms where the two conflict.
Who can use the Services
You must be at least 18 years old, or the age of majority where you live if that is higher, to create an account. The Services are designed for educators, school and district staff, and other adults interested in education. They are not intended for students or children.
Your account
- Give accurate information and keep it up to date.
- Keep your password and sign-in links private, and tell us at team@pedagogyfutures.org if you think someone else has used your account.
- One account is for one person. Do not share it or sell it.
- You are responsible for what happens under your account unless it was caused by our failure to protect it.
You can delete your account at any time from Your data in the dashboard.
Organization accounts
A school or district can set up an organization on PedagogyFutures, buy seats, and invite its staff. If you accept an invitation, the organization's administrators can see your membership, course enrolments, progress, and certificates, as described in the Privacy Policy. Administrators are responsible for inviting only people they are authorized to invite. The number of seats an organization has is set by its agreement or invoice with us.
Using the Services responsibly
When you use the Services, do not:
- break the law or help someone else break it;
- post or upload anything that is unlawful, harassing, hateful, sexually explicit, or that infringes someone else's rights;
- post information that identifies students or other people without a lawful basis and any permission you need, including students' names, grades, or records;
- impersonate anyone, or misrepresent your connection with a school or organization;
- send spam or unsolicited advertising through forums, forms, or messages;
- try to get into accounts, data, or systems you are not allowed to access, or test the security of the Services without our written permission;
- interfere with the Services, for example by overloading them, spreading malware, or getting around rate limits, access controls, or paywalls;
- scrape, copy, or download content in bulk, or use automated means to access the Services, except through features we provide for that purpose;
- resell or redistribute paid content, or share access to it with people who have not paid for it.
We may remove content and suspend or close accounts that break these rules. Where it is reasonable to do so, we will tell you why and give you a chance to respond.
Community content
Forums and groups let members post topics, replies, files, and reactions. You keep ownership of what you post. By posting, you give PedagogyFutures a non-exclusive, worldwide, royalty-free licence to host, store, display, reproduce, and adapt it (for example to fit it on a phone screen) so that we can run the Services. This licence ends when you delete the content or your account, except for copies other members have already quoted, content in our backups until they expire, and anything we must keep by law.
You are responsible for what you post and confirm that you have the right to post it. Posts show your display name to other people who can open that forum or group, and some forums are public. Members' views are their own and not ours. We moderate forums but do not review every post before it appears. You can report a post that breaks these Terms using the report option on the post or by emailing team@pedagogyfutures.org.
Our content and licence to you
Courses, lessons, lesson plans, resources, prompts, webinar recordings, graphics, and the rest of the material on the Services belong to PedagogyFutures or to the people who licensed them to us, and are protected by copyright and other laws. Unless a resource says otherwise, we give you a personal, non-transferable, revocable licence to use them for your own professional learning and teaching, including sharing classroom materials with your own students and colleagues at your school with credit to PedagogyFutures. You may not sell our materials, publish them as your own, or use them to build a competing service.
Some materials carry their own licence (for example a Creative Commons licence). Where they do, that licence applies instead.
The PedagogyFutures name and logo are ours. Please do not use them in a way that suggests we endorse you without our permission.
Artificial intelligence and outside tools
Much of what we teach is about using artificial intelligence tools in education, and the prompt library contains prompts written for use with AI tools run by other companies. We do not operate those tools and are not responsible for what they produce, how they handle the information you give them, or whether they are right for your classroom. AI output can be inaccurate, biased, or inappropriate. Check it before relying on it, follow your school's policies, and do not put student information or other sensitive data into an AI tool unless your school has approved that use.
Our courses and resources share professional guidance for educators. They are not legal, medical, or other professional advice, and they do not replace your school's policies or your own professional judgment.
Certificates and continuing education credit
We issue certificates when you complete the requirements of a course. Whether a certificate counts toward licensure renewal, professional development hours, or graduate credit depends on your state, district, or institution. Where we list an approval, it reflects our understanding at the time; please confirm with the body that awards the credit before you rely on it.
Purchases, subscriptions, and donations
Some courses and membership plans are paid. Prices and what each plan includes are shown before you pay. Payments are processed by Stripe, and by paying you also agree to Stripe's terms for that payment.
- Subscriptions renew automatically at the end of each billing period until you cancel. You can cancel at any time from the billing section of your dashboard, and the plan stays active until the end of the period you have paid for.
- Refunds are described in our Refund Policy. Nothing in these Terms or the Refund Policy takes away a right to cancel or to a refund that the law where you live gives you.
- Price changes apply from your next billing period, and we will tell you before they do.
- Donations to PedagogyFutures are gifts to a 501(c)(3) nonprofit and are generally not refundable. If a gift was charged twice, charged the wrong amount, or made by mistake, tell us within 30 days and we will refund it, as the Refund Policy explains. We send a receipt for each donation.
Webinars and events
Webinars run on Zoom, and Zoom's terms apply to your use of it. We may record webinars and publish the recording. If you speak, turn on your camera, or type in the chat during a recorded session, that may appear in the recording. We may change or cancel an event; if you paid for it, we will offer a refund.
Third-party services and links
The Services link to and embed content from other companies, such as Vimeo, YouTube, Zoom, Google, and Stripe. Their terms and privacy policies govern your use of their services, and we are not responsible for them.
Signing in on other sites
Your PedagogyFutures account can be used to sign in to partner sites. ethicaledtech.org and futureofeducation.ai are projects of Pedagogy Ventures LLC, a separate company, and their courses and resources are offered free through PedagogyFutures. We provide the account and the sign-in, and Pedagogy Ventures LLC runs those websites under its own terms and privacy policy. When you sign in to one of them, we share the account details described in the Privacy Policy with that site. Questions about your account go to us; questions about those websites go to Pedagogy Ventures LLC.
Changes to the Services and these Terms
We may change, add, or remove features of the Services. If we make a change that materially reduces what you have paid for, we will tell you and offer a pro-rated refund or a reasonable alternative.
We may update these Terms. The date at the top shows the latest version. If a change is significant, we will tell you by email or on the site before it takes effect. If you keep using the Services after the change takes effect, the new Terms apply. If you do not agree with them, you can stop using the Services and delete your account.
Ending your use of the Services
You can stop using the Services and delete your account at any time. We may suspend or close your account if you seriously or repeatedly break these Terms, if the law requires it, or if we stop offering the Services. Where reasonable we will give you notice first. If we close a paid account for a reason other than your breach of these Terms, we will refund the unused part of what you paid.
Sections that by their nature should survive, including those on ownership, disclaimers, limits of liability, indemnity, and governing law, continue after your account ends.
Disclaimers
We work hard to keep the Services accurate, available, and useful, but we provide them "as is" and "as available". To the extent the law allows, we do not make promises beyond those in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, and we do not promise that the Services will be uninterrupted or error-free.
Limitation of liability
To the extent the law allows, PedagogyFutures and its directors, officers, staff, and volunteers are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or lost opportunities, arising from or relating to the Services or these Terms.
To the extent the law allows, our total liability for all claims relating to the Services or these Terms is limited to the greater of (a) the amounts you paid us for the Services in the twelve months before the claim arose, and (b) one hundred U.S. dollars (US$100). For free Services, that means US$100.
Nothing in these Terms limits or excludes liability for gross negligence, willful or reckless misconduct, or fraud, for death or personal injury caused by negligence, or for anything else that cannot be limited or excluded under applicable law. Your rights under Massachusetts General Laws chapter 93A, and under any other consumer protection law that cannot be waived by agreement, are not affected. If you are a consumer in the European Economic Area, the United Kingdom, or Switzerland, you keep the rights that mandatory consumer law gives you, and these limits apply only as far as that law allows. As a charitable organization, PedagogyFutures also keeps any statutory protection available to charitable organizations; these Terms do not waive it.
Indemnity
If you use the Services in a way that breaks these Terms or the law, and a third party makes a claim against PedagogyFutures because of it, you agree to cover our reasonable losses and costs from that claim, to the extent the law allows. This section does not apply to consumers where local law does not permit it.
Governing law and disputes
These Terms are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to its conflict of laws rules. Before starting a formal dispute, please email team@pedagogyfutures.org so we can try to resolve it informally. Any dispute that cannot be resolved that way will be handled by the state courts in Suffolk County, Massachusetts, or the federal courts in Boston, Massachusetts, and you and we agree to their jurisdiction. If you are a consumer and the law where you live gives you the right to bring a claim in your local courts, you may do that instead.
If you are a consumer in the European Economic Area, the United Kingdom, or Switzerland, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim in the courts of that country. Nothing in these Terms limits rights you have as a consumer that cannot be changed by agreement.
General
- These Terms, together with the Privacy Policy, the Cookie Policy, the Refund Policy, and any written agreement with your organization, are the whole agreement between you and us about the Services.
- If part of these Terms cannot be enforced, the rest stays in effect.
- If we do not enforce a right straight away, we have not given it up.
- You may not transfer your rights under these Terms without our consent. We may transfer ours to an organization that takes over the Services, and we will tell you if that happens.
